A hibah is a gift made during one's lifetime and takes effect immediately upon meeting its conditions. How long does estate administration typically take in Malaysia?
The timeline varies considerably depending on whether a grant of probate or letters of administration are required, the complexity of assets involved, and how quickly documentation can be gathered. Does faraid apply to all Muslims in Malaysia?
For Muslims in Malaysia, faraid principles govern the distribution of assets not covered by a valid hibah or trust arrangement. Non-Muslims distribute estates under the civil law framework, namely the Distribution Act 1958 or the relevant personal law. Where a family includes members of different faiths or involves both frameworks, careful planning is particularly worthwhile. Our team is familiar with both contexts.
